Recognition and Enforcement of Foreign Divorce Decrees in Türkiye

Divorce decrees issued by foreign courts for Turkish citizens or dual nationals living abroad do not automatically become legally effective in Türkiye. Under the Turkish Private International Law and Procedural Law Act (MÖHUK), judgments rendered by foreign courts do not automatically produce legal effects in Türkiye.

For a foreign divorce decree to have legal effect in Türkiye, it may be necessary to initiate recognition and enforcement proceedings before a Turkish court.

Unless a foreign divorce decree is recognized by Turkish courts, the parties may continue to be considered legally married under Turkish law. This can create significant legal problems, particularly for individuals who wish to remarry in Türkiye.

Where the foreign judgment also contains provisions concerning maintenance, custody, compensation or other enforceable obligations, an enforcement decision may additionally be required.

What Is the Difference Between Recognition and Enforcement?

There are two separate legal concepts concerning the legal effect of a foreign divorce decree in Türkiye:

Recognition of a Foreign Divorce Decree

Recognition means that the foreign court judgment is accepted as having the effect of a final and binding judgment in Türkiye.

If the purpose is primarily to have the foreign divorce reflected in Turkish civil registry records, recognition of the divorce decree may be sufficient, provided that the applicable legal requirements are met.

Enforcement of a Foreign Divorce Decree

Enforcement allows certain provisions contained in a foreign judgment to be enforced in Türkiye through Turkish enforcement authorities.

For example, enforcement may be relevant where the foreign divorce judgment includes obligations concerning:

  • Spousal maintenance;

  • Child custody;

  • Compensation;

  • Payment of a specific amount of money; or

  • Other obligations requiring enforcement in Türkiye.

Therefore, recognition and enforcement should not be treated as identical procedures. Whether recognition alone is sufficient depends on the legal effect that the applicant seeks to obtain in Türkiye.

Can a Foreign Divorce Be Recognized Through the Civil Registry Office?

Recent legal regulations have made it possible, under certain conditions, for a foreign divorce decision to be recognized through an administrative application to the Turkish civil registry authorities rather than through court proceedings.

However, this procedure has important limitations.

Both Spouses Must Apply

Both spouses must make the application together, either personally or through their authorized representatives.

An application made by only one spouse is generally not sufficient for recognition through the civil registry procedure.

Recognition Through the Civil Registry Does Not Provide Enforcement

One of the most important limitations is that provisions concerning matters such as maintenance, child custody, property division and compensation cannot be enforced in Türkiye through the civil registry procedure.

Where enforcement of these additional provisions is required, judicial proceedings before a Turkish court may be necessary.

What Documents Are Required for Recognition and Enforcement of a Foreign Divorce Decree?

To ensure that recognition and enforcement proceedings proceed smoothly, the required documents should be prepared completely and in accordance with Turkish procedural requirements.

The main documents generally include:

  1. Original Foreign Divorce Decree: The original judgment issued by the foreign court, bearing the required signature, seal or other official authentication.

  2. Certificate of Finality: An official document showing that the foreign divorce judgment has become final and is no longer subject to ordinary appeal in the country where it was issued.

  3. Apostille: Where applicable, an apostille confirming the authenticity of the public document for international use.

  4. Certified Turkish Translation: Foreign-language documents must generally be translated into Turkish by a sworn translator and notarized as required.

Example: Divorce Decrees Issued in Germany

For Turkish citizens divorced in Germany, the German divorce judgment should generally contain the relevant “Rechtskraftvermerk”, confirming that the judgment has become final.

Depending on the document and the applicable German procedure, the judgment may also need to be apostilled by the competent German authority before it can be submitted to Turkish authorities.

Because document requirements may vary depending on the country where the divorce was granted, the documents should be reviewed before proceedings are initiated.

Which Court Has Jurisdiction Over Recognition and Enforcement Proceedings?

Recognition and enforcement proceedings concerning a foreign divorce decree fall within the scope of family law and are generally brought before the Family Court (Aile Mahkemesi) in Türkiye.

As a general rule, jurisdiction is determined according to the defendant's residence in Türkiye.

If the defendant does not have a residence in Türkiye, the court of the defendant's habitual place of residence in Türkiye may have jurisdiction. If neither exists, the proceedings may be brought before a competent court in Ankara, Istanbul or Izmir, subject to the applicable procedural rules.

Because jurisdictional rules may depend on the circumstances of the parties, the appropriate court should be determined before filing the case.

How Long Does Recognition and Enforcement of a Foreign Divorce Decree Take?

One of the main factors that can significantly delay these proceedings is service of process.

The court must properly notify the other spouse of the proceedings. If the other spouse lives abroad—for example, in Germany—and does not have a lawyer in Türkiye, international service procedures may be required.

Depending on the circumstances, international service and the waiting periods associated with it may significantly extend the duration of the proceedings.

How Can the Process Be Accelerated?

One practical way of avoiding delays caused by international service is for both spouses to appoint lawyers in Türkiye.

If both parties are represented by separate attorneys in Türkiye, court notifications can generally be served on their attorneys in Türkiye instead of being sent abroad.

Depending on the circumstances of the case and whether the necessary procedural requirements are satisfied, this can significantly shorten the proceedings. In appropriate cases, the parties may also be able to complete the proceedings without personally travelling to Türkiye.

Why Should You Work With a Lawyer for Recognition and Enforcement Proceedings?

Recognition and enforcement of a foreign divorce decree in Türkiye is not simply a matter of translating the judgment and submitting it to a court.

The procedure may involve issues concerning:

  • Turkish private international law;

  • The requirements of MÖHUK;

  • International service of process;

  • Finality of the foreign judgment;

  • Apostille requirements;

  • Certified translations;

  • Jurisdiction of Turkish courts; and

  • Enforcement of additional provisions such as maintenance, custody and compensation.

Failure to comply with the applicable procedural requirements may result in significant delays or procedural problems.

Frequently Asked Questions About Recognition of Foreign Divorce in Türkiye

Is a foreign divorce automatically valid in Türkiye?

No. A foreign divorce judgment does not automatically produce all of its legal effects in Türkiye. Depending on the circumstances, recognition through the civil registry or judicial recognition proceedings may be required.

Can I remarry in Türkiye after getting divorced abroad?

The foreign divorce generally needs to be properly recognized in Türkiye before the divorce can be reflected in the Turkish civil registry. This is particularly important where the person's marital status in Türkiye has not yet been updated.

Do both spouses need to apply for recognition?

For the administrative recognition procedure through the civil registry, both spouses generally need to apply together, either personally or through their authorized representatives. Judicial recognition proceedings may follow different procedural rules.

Do I need an apostille for my foreign divorce judgment?

An apostille may be required for foreign public documents submitted to Turkish authorities, depending on the country where the document was issued and the applicable international agreements and procedures.

Can a foreign maintenance or custody decision be enforced in Türkiye?

Recognition of the divorce itself and enforcement of additional provisions are legally distinct matters. If maintenance, custody, compensation or another obligation needs to be enforced in Türkiye, a judicial enforcement procedure may be required.

Do I have to come to Türkiye for the recognition and enforcement case?

Not necessarily. Depending on the circumstances and the powers granted under the relevant power of attorney, the proceedings may be conducted through a lawyer in Türkiye without the parties personally attending the hearing.

Can a lawyer in Türkiye handle my foreign divorce recognition case?

Yes. A lawyer authorized to act on your behalf in Türkiye can handle the necessary proceedings before the competent Turkish authorities and courts, subject to the requirements of the applicable power of attorney and procedural rules.
